From law firms to consulting agencies, these tools not only enhance productivity but also come with legal risks that can muddy the waters of AI adoption. A recent study led by Cathy Yang and her colleagues dives into the nuances of how disclosure policies affect the use of AI tools like ChatGPT in professional service firms. Why Should we Care about GPT Adoption?

Generative Pre-trained Transformers (GPTs) have taken the world by storm, offering incredible opportunities for content creation and efficiency. For example, if a consultant generates reports with GPT but doesn’t disclose it, the manager may not realize the potential risks associated with the AI-generated content—like misinformation or confidentiality violations.

The Hamburg Labor Court ruling in 2024 has brought this issue to the forefront; it determined that if an employer doesn’t know which employees are using generative AI tools or how frequently they’re used, they’re not technically monitoring their employees. This creates a tricky dynamic where firms can’t enforce accountability.

The Principal-Agent Problem: A Quick Dive

To navigate this complex landscape, the researchers applied something called agency theory. This idea revolves around the relationship between a principal (like a manager) and an agent (an employee). It’s a dynamic fueled by differing interests; agents often prioritize their self-interest over the principal’s objectives, leading to potential misalignments.

Imagine a manager who is unaware that their analyst is relying heavily on ChatGPT to prepare a report. The manager might incorrectly assess the quality of work, believing their employee has spent hours meticulously crafting the content, when in reality, they mere clicked a few buttons. This discrepancy can lead to an increase in agency costs—basically, the expenses and inefficiencies that come from misaligned interests.

The Role of Disclosure Policies

Here’s where disclosure policies come into play. The study examined whether informing managers about their employees’ use of tools like ChatGPT minimizes information asymmetry (the gap in knowledge between managers and employees). After all, if managers know how much their teams are relying on AI, they can make more informed decisions regarding content quality—and adjust accordingly.

The research team conducted an experiment where consulting managers evaluated two sets of documents: one was created without the help of GPT, and the other was enhanced by it. In some scenarios, the managers were informed about GPT’s involvement; in others, they weren’t. This setup was crucial for understanding how disclosure impacts managers’ perceptions and their willingness to adopt these tools in their workflows.

  1. Information Asymmetry Exists: Managers were often unaware of the extent to which their analysts were using GPT when disclosure policies weren’t in place, leading to a misjudgment regarding content quality.

  3. Underappreciation of Analysts’ Efforts: When GPT usage was disclosed, managers seemed to undervalue the effort analysts put into their final outputs. This misvaluation could potentially discourage analysts from using AI tools in the first place.

  4. Mixed Reactions to Disclosure Policies: While enforced disclosure decreased information asymmetry, it did not fully align the interests of managers and analysts. Sometimes it even backfired, leading to less favorable evaluations for analysts who disclosed their use of GPT.

  5. Risk Concerns Remain: Managers tended to find GPT useful but were equally apprehensive about the risks associated with its usage, such as the potential for misinformation—a real concern when analysts are handling sensitive client data.

The Importance of AI Corporate Policies

Given the complexities highlighted in the study, the researchers advocate for a comprehensive AI corporate policy that could include the following elements:

  1. Mandatory Disclosure Obligations: Employees should inform managers when using AI for their tasks, reducing information asymmetry.

  2. Risk-Management Framework: By integrating AI tools into contractual duties, both parties (agents and principals) would know their responsibilities and avoid undue risks.

  3. Monitoring Mechanisms: Incorporating checks on whether employees disclose their use of GPT will alleviate legal and ethical risks for the firm.

  4. Incentive Structures: To encourage responsible AI use, it’s crucial to create systems that acknowledge the contributions of employees, ensuring they feel valued and are not at risk of losing recognition or salary due to reliance on AI tools.

Real-World Applications of These Insights

For managers in consulting and other professional service industries, the implications are clear. Implementing comprehensive AI policies can:

  • Foster a Culture of Transparency: When everyone knows the rules, there’s less room for misunderstandings. This will likely lead to a more cohesive working environment.
  • Enhance Accountability: A culture of disclosure ensures that all team members are held accountable, which further mitigates risk.
  • Boost Employee Morale: When employees feel seen and valued—especially regarding their input and how tools like GPT are leveraged—they are more likely to adopt these technologies, benefiting the entire organization.
